1 – GENERAL DISPOSITIONS

By completing the order form that appears on this website and confirming the order (by clicking on the “confirm order” button), you fully accept these general conditions of sale, which alone shall apply to the following contract.

Jean-Paul Hévin reserves the right to refuse an order if a customer fails to fulfill any of his/her obligations.

If an order is accepted, the Jean-Paul Hévin company undertakes to sell and ship the products ordered by the customer via a high-quality carrier under the best possible conditions at the price specified on the invoice generated by the order form.

 

2 - OBLIGATIONS OF THE CUSTOMER

The customer undertakes to complete the order form correctly, along with his/her address and delivery address during business hours + phone number.

Otherwise, the order will not be accepted. Delivery addresses must not be postal boxes but must be the physical addresses.

The customer is prohibited from reselling the products, the order being exclusively for the personal use of the customer or the person to whom it is shipped. The resale of the professional product line is restricted to restaurants and hotels, on the condition that these products may be sold to their customers only in connection with the principal service provided.

Our customers agree to comply with the storage conditions of the products, as well as the expiration date indicated on the packages.

 

3 - PRICING

The prices of the products are net and include all taxes. Delivery charges are extra. Prices are guaranteed for as long as supplies last and subject to any change in the VAT rate. All prices are in euros.

 

4 - PAYMENT

Products shall be paid for by Visa, MasterCard or American Express only, from our website, through the Stripe secured payment system. The validation of payment by credit card is immediate. No delivery shall be done without the validation of payment.

 

5 – DELIVERY CHARGES

Each product has a net weight and a gross weight: delivery charges are fixed according to the package’s weight and volume, and its shipping zone.

Particularity of shipments by Fedex and Chronopost outside the European Union : taxes and customs fees related to the importation of products are included in the shipping costs and paid by the customer when ordering online.

Some countries do not appear in the list of destination countries (difficulties in delivery, ban on importaing foodstuff, etc...)

6 - CANCELLATION RIGHTS

The 7 day cancellation delay does not apply to contracts that supply perishable, agro-food products such as goods sold by Jean-Paul Hévin. Also, the Client will not be able to take advantage of this.

However, a change or cancellation by the client may be taken into account if the package is being prepared, and has not yet been sent. This possibility applies on a case-by-case basis. In the case of cancellation, refund will be credited to the customer's credit card. If the parcel has been sent to the carrier, no amendment or cancellation will be considered.

 

7 – DELIVERY

Orders, after payment acceptance by the bank card centre, are prepared and shipped during the day of the order for those placed Monday-Friday before noon, the next day for orders registered after 11:00 a.m. (except weekends and public holidays). Those order recorded Friday after 11:00 am, and on Saturday and Sunday, are shipped Monday (except holidays).

After confirmation of the order, Jean-Paul Hévin agrees to process and route the order to the agreed destination, according to the route, the procedure and the carrier chosen by the customer. Jean-Paul Hévin ensures the goods up to the place of delivery, but it is up to the recipient to check the parcel in the presence of the deliveryman. Any anomaly during the delivery must be indicated on the delivery note. Without compliance with this clause, no reimbursement procedure with the chosen carrier can be initiated.

The client has the choice among several shipping methods for his/her order: Colissimo, Chronopost, FedEx, Courier.

Delivery times vary depending on the selected carrier, the country of destination and customs clearance procedures. These are provided for information only. No compensation can be requested for any delivery delay.

For deliveries outside the European Union, the recipient shall pay all taxes required for product importation and claimed upon delivery of the package, such as customs duties, value added tax, and other taxes owing under the laws of the receiving country.

Some countries do not appear in the list of countries of destination (delivery difficulties, prohibition to import foodstuffs...).

In the absence of the recipient or a person who can take possession of the products upon delivery, and insofar as it has access to the mailbox of the recipient, the carrier will leave a delivery notice at the delivery address inviting the recipient to call and pick-up the parcel at the nearest retrieval centre.

Jean-Paul Hévin shall in no case be held responsible for a delivery return due to an address error or a failure to deliver to the address indicated.

When a delivery address is incomplete or inaccurate, Jean-Paul Hévin reserves the right to directly contact the recipient by telephone to complete the missing delivery information as long as the telephone number is not wrong and the available recipient is available.

Orders indicating a P.O. Box address will not be considered nor processed.

Exceeding delivery standards cannot give rise to damages and interest.

Jean-Paul Hévin cannot be held liable if the product could not be delivered in the event of an unexpected event or natural disaster.

The client is warned that, for remote destinations (between 3 and 5 delivery days) and despite special packaging used during the warm seasons, artisanal chocolates will travel better during colder seasons.

Delivery by courier is possible in Paris only in the next hours following the order confirmation, from Monday to Saturday 10am-6pm (except lockdown : 5pm).

 

8 - PICK-UP BOUTIQUE

In the case of a Pick-up Boutique order, the customer agrees to pick-up his/her order on the selected day and during the time slot chosen. Jean-Paul Hévin cannot keep an order that might have been forgotten by the client. Any forgotten order will not be refunded.

 

9 - APPROVISIONNEMENT

Jean-Paul Hévin’s products are hand-made and are available in limited quantities.

In case of stock outages, Jean-Paul Hévin will contact the client by e-mail or telephone as soon as possible to agree with him/her: to delay delivery pending replenishment of the product, when possible, or to replace the product with another equivalent product in quality and price.

Orders placed between 12/15 and 1/31 are less likely to be confirmed than those placed at other times of the year.

 

10 - CLAIM

The customer should ensure that the product delivered is consistent with the product ordered. For a claim to be valid, it must be made within 48 hours of receipt.

11 - NULLITY - FORCE MAJEURE – APPLICABLE LAW

If any of these general conditions is declared to be unenforceable or null and void for any reason whatsoever, such nullity shall not affect the enforceability or validity of the other provisions of the general conditions, and the null or unenforceable provision shall be replaced by one that is as comparable as possible. Neither the Jean-Paul Hévin company nor the customer may be held liable for breach of contract resulting from an instance of force majeure beyond its control.

These general conditions are governed exclusively by French law. The Commercial Court of Paris shall have sole jurisdiction over any litigation or dispute relating thereto.

 

12 - DATA PROTECTION

By ordering from the Jean-Paul Hévin website, the client consents to the use by Jean-Paul Hévin of any nominative data about her/him. This data is necessary to ensure the correct and smooth processing of orders.

All such information is treated with the greatest rigour and the utmost discretion. The file with this information has been submitted to the Commission Nationale de l'Informatique et des Libertés.

You are entitled to access, modify, correct, and delete any data that concern you (art. 34 of the French Data Protection Act of January 6, 1978).
